Parental Consent and Waiver

I, the undersigned parent or legal guardian ("Parent") of the participant identified at booking ("Participant"), consent to the Participant's enrollment in coaching sessions arranged through the NxtLevel NIL platform (the "Platform"), operated by NxtLevel NIL Inc. ("NxtLevel").

I confirm that I am the Participant's parent or legal guardian and that I have full authority to provide this consent on the Participant's behalf.

I understand that participation in athletic training carries inherent risks of injury, including but not limited to sprains, strains, fractures, concussions, heat-related illness, and other physical harm. These risks cannot be entirely eliminated even with reasonable precautions and qualified coaching.

I voluntarily accept these risks on the Participant's behalf and acknowledge that the Participant's enrollment in coaching sessions is undertaken with full understanding of the physical demands involved.

To the fullest extent permitted by law, I release, waive, and discharge NxtLevel NIL Inc., its officers, directors, employees, agents, contractors, and the coaching athletes (collectively, "Released Parties") from any and all claims, demands, losses, or damages arising out of or related to the Participant's involvement in coaching sessions, including claims arising from the ordinary negligence of any Released Party.

This release does not apply to claims arising from gross negligence, willful misconduct, or any conduct that cannot lawfully be released under applicable Colorado law.

I agree to indemnify and hold harmless the Released Parties from any claim or demand brought by or on behalf of the Participant arising from the Participant's involvement in coaching sessions, except to the extent such claim arises from gross negligence or willful misconduct of a Released Party.

I represent that the Participant is physically able to participate in athletic training and has no known medical condition that would make participation unsafe, except as disclosed at booking.

In the event of an injury or medical emergency during a coaching session, I authorize the coaching athlete and any responding medical personnel to provide reasonable first aid and to seek emergency medical care if needed. I understand that NxtLevel does not provide medical care and is not financially responsible for any medical treatment incurred.

I will inform NxtLevel and the coaching athlete of any allergies, medical conditions, accommodations, or special considerations relevant to the Participant's safe participation, prior to the session.

I have reviewed the NxtLevel NIL Code of Conduct (available at nxtlevelnil.com/code-of-conduct). I acknowledge that the Participant and I will abide by it during all interactions related to coaching sessions.

I understand that I may report any concern about athlete behavior, session conduct, or safety directly to safety@nxtlevelnil.com or via the reporting form on the Trust & Safety page. NxtLevel investigates every report.

I grant NxtLevel a non-exclusive, royalty-free license to use photographs or video taken during coaching sessions for the purpose of marketing, promotion, and platform improvement, provided that the Participant's full name is not used in association with the image without separate written consent.

I may withdraw this photo release at any time by emailing privacy@nxtlevelnil.com. Existing uses prior to withdrawal are not retroactively revoked.

I understand that this photo release is optional and that declining to grant it does not affect my ability to book sessions through the Platform.

I agree that:

(a) The Participant will arrive on time, in appropriate athletic attire, with any equipment specified at booking.

(b) I am responsible for deciding whether to remain at or near the session location and for the Participant's supervision. NxtLevel does not require me to remain on-site for any session; drop-off and pick-up are permitted, and I accept responsibility for that decision.

(c) Sessions are typically held outdoors. I accept that NxtLevel may reschedule sessions due to weather, facility access, or other reasonable conditions.

(d) I will follow the cancellation policy as described in the Terms of Service. Cancellation requests can be made via the link in the booking confirmation email.

I have read this Parental Consent and Waiver carefully. I understand its terms and acknowledge that by checking the consent box at booking and completing payment, I am entering into a legally binding agreement on behalf of myself and the Participant.

If any portion of this Waiver is held to be unenforceable, the remaining portions shall remain in full force and effect.

This Waiver shall be governed by the laws of the State of Colorado.
